Terms and Conditions

These Terms and Conditions apply to all agreements and transactions between Dreamsy, located at Brederodestraat 4, Bergschenhoek, 2662 AZ, and registered with the Dutch Chamber of Commerce under number [KvK number] (hereinafter: “Dreamsy” or “we”), and any natural or legal person (hereinafter: “Customer” or “you”) entering into an agreement with Dreamsy.

1. Definitions

1.1 Terms – These general terms and conditions.
1.2 Agreement – Any arrangement concerning the delivery of products and/or services by Dreamsy.
1.3 Product(s) and/or Services – All goods and services offered by Dreamsy.
1.4 Customer Data – Any information provided by the customer in the context of an agreement.

2. Applicability

2.1 These terms apply to all offers, agreements, and deliveries by Dreamsy, unless agreed otherwise in writing.
2.2 Deviations are only valid if confirmed in writing by Dreamsy.
2.3 If any clause is found invalid or unenforceable, the remaining provisions remain in full effect.

3. Orders & Agreements

3.1 All offers by Dreamsy are non-binding, unless explicitly stated otherwise.
3.2 An agreement is established once confirmed by Dreamsy in writing.
3.3 Dreamsy reserves the right to modify products, prices, or services without prior notice.

4. Prices & Payment

4.1 All prices are in euros and include VAT, unless otherwise stated.
4.2 Payments must be made via the payment methods provided on our website.
4.3 In case of late payment, legal interest and collection fees apply.

5. Delivery & Shipping

5.1 Dreamsy aims to deliver orders within 4–9 business days but cannot guarantee exact delivery times.
5.2 Delays do not entitle the customer to compensation or cancellation.
5.3 The risk of loss or damage passes to the customer upon delivery.

6. Returns & Right of Withdrawal

6.1 New customers are entitled to a 100-day money-back guarantee, subject to conditions as described in our Return Policy.
6.2 Returning customers may return unused products within 30 days at no cost, provided all conditions are met.
6.3 Return requests must be submitted via email to support@dreamsy.com.
6.4 Upon approval, Dreamsy provides return instructions and, where applicable, a free return label.
6.5 Refunds are issued after receipt and inspection, via the original payment method.
6.6 Used, washed, or discounted items cannot be returned.

7. Warranty & Complaints

7.1 Dreamsy guarantees its products meet high quality standards.
7.2 Complaints must be reported within 7 days of receipt, including photo evidence.
7.3 If valid, Dreamsy will offer a replacement or full refund.

8. Liability

8.1 Dreamsy is only liable for direct damages caused by intent or gross negligence.
8.2 We are not liable for indirect or consequential damages or lost profits.

9. Intellectual Property

9.1 All content, designs, and product rights remain the property of Dreamsy.
9.2 Reproduction or use of our materials without written permission is prohibited.

10. Privacy & Data Protection

10.1 Personal data is processed in accordance with our Privacy Policy.

11. Force Majeure

11.1 Dreamsy is not liable for delays or damages due to force majeure (e.g. natural disasters, pandemics, strikes, technical failures).
11.2 In such cases, the agreement may be suspended or terminated without liability.

12. Governing Law & Jurisdiction

12.1 All agreements are governed by Dutch law.
12.2 Disputes shall be submitted to the competent court in the Netherlands.

13. Amendments

13.1 Dreamsy reserves the right to amend these terms at any time.
